Representative assignments include:

LeJeune Steel Company

Consultant and Technical Expert to LeJeune Steel Company and its attorneys on various change orders, requests for equitable adjustment, and successful dispute resolution in state court. LeJeune Steel was responsible for a multi-million dollar contract to furnish, fabricate, and erect complex structural steel components for the Millennium Park Outdoor Music Pavilion Project in downtown Chicago, Illinois.

Duggan and Rhodes Group, LLC (DRG)

Consultant and Technical Expert to DRG and its attorney client representing Indiana University of Pennsylvania (IUP). IUP’s contractor, Cooper Industries, was responsible for design and installation of a 24MW co-generation facility using reciprocating engines and waste heat recovery to provide electrical energy, steam, and hot water heat to IUP. Consultant provided services for measuring incurred damages and supporting dispute settlement arising out of breach of contract and other actions by Cooper Industries that adversely affected energy production for IUP use.

Consultant and Technical Expert to DRG and its attorney client representing Lurges Lentjes North America, Inc (LLNA). LLNA was responsible for the engineering, procurement and construction of two selective catalytic reduction units for Units 1 and 2 at the PSEG Mercer Station located in New Jersey. Consultant evaluated the project percent complete, measured the values of completed and uncompleted work at the time of an unexpected contract termination for default by LLNA’s utility client, and reviewed utility counterclaims.  Consultant provided technical expert services and provided testimony before an arbitration panel regarding these matters.

Fluor Fernald

Consultant and Technical Expert to Fluor Fernald and its attorneys in a dispute over settlement costs arising from its termination of a subcontractor for convenience. The subcontract was for a multi-million dollar complex environmental nuclear cleanup project at the Department of Energy, Fernald Site located in Ohio. Consultant provided cost engineering services and other services for the detailed analysis of estimates of project craft labor productivity and other costs to derive certain reasonable cost impacts in anticipation of litigation.

British Nuclear Fuels Limited, Inc (BNFL)

Consultant and Technical Expert to BNFL, Inc. on various change orders and requests for adjustment matters related to a several hundred million dollar prime contract with the Department of Energy. BNFL was under contract for the decontamination, decommissioning, and recycling services for three Gaseous Diffusion Plant buildings (K-29, K-31, and K-33) in the East Tennessee Technology Park (formerly the K-25 Site) in Oakridge, TN. Consultant was responsible for providing strategic guidance, thought leadership, and technical support services in support of efforts to successfully recover costs associated with the impacts arising from many unforeseeable direct impact changes that occurred during the contract lifecycle. Services included

  1. Preparation of “as-planned” project schedules and other initial project performance baselines
  2. Forensic (retrospective) reconstruction and support of the “as-built” project schedule and other actual performance indicators
  3. Schedule and other performance variance analysis from “as-planned”. This work was used to
    1. Identify and segregate the changes attributable to the government and/or any other causal factors
    2. Measure the schedule and performance impact of the changes and quantify the resultant costs
    3. Support the measurement and pricing of claims for delay, disruption, interference, acceleration, and any other impacts.
